Terms of Service

1. What the service is
sprks is an AI-assisted social media content tool. It helps creators discover content inspiration from public social platforms (X, TikTok, YouTube), draft and package their own content with AI assistance, and schedule or publish it to accounts they own.
2. Your account
You need an account to use sprks. You must provide a valid email address, be at least 18 years old (or the age of majority where you live), and keep your login method secure. You are responsible for activity under your account.
3. Your content and connected accounts
You keep full ownership of everything you create, upload, or publish through sprks. You grant us only the limited license needed to operate the service — storing your drafts and media, processing them with AI models, and transmitting them to platforms you explicitly connect (for example X or a publishing tool). You may also optionally connect your own YouTube channel with your Google account; sprks requests read-only access only and never uploads, edits, or posts anything to your YouTube channel. We never post to any connected account without an action you took, and you may disconnect a connected account at any time in Settings. 4. AI-generated content
Drafts, titles, thumbnails, and scripts produced by sprks are suggestions generated by AI. You are responsible for reviewing anything before you publish it, and for ensuring what you publish complies with the rules of the destination platform and applicable law. AI output may be inaccurate; do not treat it as professional advice.
5. Acceptable use
You agree not to use sprksto: violate any platform's terms (including X, TikTok, and YouTube); publish unlawful, deceptive, or infringing content; spam or engage in coordinated inauthentic behavior; probe, scrape, or disrupt the service; or resell access without our written consent. We may suspend accounts that break these rules.
6. Third-party platforms and data
sprks displays public content and statistics from third-party platforms, including via the YouTube API Services, and — if you connect your channel — read-only data from your own YouTube account. Your use of YouTube data through sprks is also subject to the YouTube Terms of Service, and Google's handling of data is described in the Google Privacy Policy. Third-party platforms may change or restrict their data at any time; we are not responsible for their availability or accuracy.
7. Plans, credits, and billing
sprks is sold as a subscription, billed monthly or annually. Current plans and prices are shown in Settings and again at checkout before you are charged. Subscriptions renew automatically at the end of each billing period at the then-current price until you cancel. Payments are processed by Stripe; we do not store your card details. Prices exclude taxes unless stated otherwise, and any applicable tax is added at checkout.
Credits. Paid actions in sprks — generating a draft, pulling inspiration, making a thumbnail — spend credits. Each plan includes a monthly credit allowance. Your monthly allowance resets at each renewal: credits included with your plan do not roll over, and unused ones are not refunded or carried forward. Credits you purchase separately as a top-up are added to a separate balance that does not expire and is not reset by renewal. Credits have no cash value and cannot be exchanged, transferred, or withdrawn.
Cancelling. You can cancel at any time in Settings. Cancelling stops the next renewal and you keep full access until the end of the period you have already paid for. We do not charge a cancellation fee.
Refunds. Fees are non-refundable, including for periods you did not fully use and for credits you did not spend. Cancelling does not entitle you to a refund, in whole or in part, of the current billing period. This is the whole policy — there is no separate trial-refund or satisfaction-guarantee window. We may make an exception at our discretion, and we will always refund a charge that was our error, such as a duplicate charge or a charge after a cancellation was confirmed. Nothing here limits rights you have under the consumer law where you live.
Before you pay. Every plan can be tried first — the free trial requires no card, and it is there so you can decide before any money changes hands.
Failed payments and price changes. If a renewal payment fails we may retry it and may suspend paid features until it succeeds. If we change prices we will tell you by email at least 30 days before the change takes effect, and you can cancel before it applies.
8. Disclaimer and limitation of liability
The service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, loss of profits, or loss of data arising from your use of the service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim (or USD 100 if you paid nothing).
9. Termination
You can stop using the service and request account deletion at any time by emailing hello@sprks.xyz. We may suspend or terminate accounts that violate these terms, with notice where reasonable.
10. Changes
We may update these terms as the product evolves. If a change is material we will notify you in the app or by email before it takes effect. Continued use after the effective date means you accept the updated terms.
